Terms of Service

These terms govern your access to and use of the Soba Labs website and the services we make available through it. Please read them carefully before using the site.
1.Acceptance of these terms
By accessing or using the Soba Labs website at sobalabs.ai and any related pages, tools, or services we make available through it (together, the "Services"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with them, please do not use the Services. If you use the Services on behalf of a company or other organisation, you confirm that you have authority to accept these Terms for that organisation.

3.What these terms cover
These Terms apply to your use of our public website and the information, pages, and booking or contact tools available on it. They do not by themselves create any engagement for software development, training, or other professional services. Any such engagement is governed by a separate written agreement signed between Soba Labs and the client, for example a master services agreement, a statement of work, or a data processing agreement. Where a separate signed agreement conflicts with these Terms, that signed agreement prevails for the services it covers.
Nothing on the Services is an offer capable of acceptance; it is an invitation to get in touch and discuss working together. No contract for our services is formed until it is agreed in a separate signed agreement.
4.Using the Services
You agree to use the Services only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the Services by, anyone else. In particular, you agree not to:
- use the Services in any way that breaches applicable law or regulation;
- attempt to gain unauthorised access to the Services, our servers, or any system or network connected to them;
- introduce malware or any other malicious or harmful code or material;
- probe, scan, or test the vulnerability of the Services, or circumvent any security or authentication measure;
- collect or harvest data from the Services for unlawful purposes, or in a way that places an unreasonable load on our infrastructure;
- copy, modify, distribute, sell, or lease any part of the Services except as expressly permitted by these Terms or applicable law.
We welcome web and AI crawlers on our public pages, as set out in our robots.txt and llms.txt. That permission does not extend to any of the prohibited activities listed above.
5.Intellectual property
Unless stated otherwise, all content on the Services, including text, graphics, logos, the Soba Labs name and marks, page design, and code, is owned by Soba Labs or its licensors and is protected by copyright and other intellectual property laws. You may view and print pages for your own reference. You may not reproduce, republish, or otherwise exploit our content for commercial purposes without our prior written permission. Content we publish under an open licence, and third-party marks shown only for identification, remain subject to their own terms.
6.Bookings and enquiries
When you book a call or contact us through the Services, for example through our scheduling tool or by email, you agree to provide accurate information. A booking or enquiry is an invitation to discuss working together. It is not a binding offer or contract, and no engagement exists until it is agreed in a separate signed agreement. We handle the personal data you submit in line with our Privacy Policy.
7.Third-party services and links
The Services rely on and link to third-party providers, for example our scheduling provider (Cal.com), our analytics and hosting provider, and may link to third-party websites. When you book a call, the details you enter are handled by our scheduling provider as described in our Privacy Policy. We do not control those third parties and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.
8.Availability and changes to the Services
We provide the Services on an "as available" basis and may change, suspend, or withdraw all or part of them at any time without notice. We do not guarantee that the Services will always be available, or that they will be free from errors or interruptions.
9.Disclaimer of warranties
The Services and their content are provided "as is" and "as available" for general information. To the fullest extent permitted by law, we make no warranties or representations, express or implied, about the accuracy, completeness, reliability, or fitness for a particular purpose of the Services or their content. Any reliance you place on the content is at your own risk. Nothing on the Services constitutes legal, financial, or other professional advice.
10.Limitation of liability
To the fullest extent permitted by law, Soba Labs will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Services. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for intentional harm or gross negligence, for fraud, or for any liability that cannot be excluded under applicable Polish or EU law. Where we provide services to a client under a separate signed agreement, the liability terms of that agreement apply to those services.
11.Consumer rights
If you use the Services as a consumer, these Terms do not affect any mandatory rights you have under Polish or EU consumer protection law that cannot be limited by agreement, including the Polish Act on Consumer Rights of 30 May 2014. Where any term conflicts with those rights, your mandatory rights prevail.
12.Data protection
We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Polish law. Our Privacy Policy explains what we collect, why, and the rights you have. By using the Services you acknowledge the Privacy Policy.
13.Changes to these terms
We may update these Terms from time to time, for example to reflect changes to the Services or to legal requirements. The current version is always posted on this page with its "Last updated" date. Your continued use of the Services after an update means you accept the revised Terms.
14.Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of Poland. The courts competent for the registered seat of Soba Labs in Wrocław, Poland, will have jurisdiction, except where mandatory law provides otherwise. In particular, if you are a consumer, nothing here deprives you of the protection of the mandatory rules, or the right to bring proceedings in the courts, of your country of residence.
